How WA's proposed rental changes stack up for tenants

STATE OF PLAY FOR RENTERS IN AUSTRALIA

NSW

* Landlords can generally only increase rents once a year with notice

* Encouragement of rental bidding to be banned under proposed laws

* Labor government has pledged to ban no-grounds evictions for tenants on periodic leases and make it easier to have pets

* Landlords cannot unreasonably withhold permission for minor home modifications

VICTORIA

* Landlords can increase rents once a year with notice

* Rental bidding outlawed

* No-grounds evictions banned for fixed-term and periodic leases

* Landlords must have a good reason to deny tenants permission to keep pets

* Renters can make some home modifications without the owner's consent

QUEENSLAND

* From July 1, rent increases to be capped at once a year

* Owners cannot unreasonably withhold permission for minor home modifications

* Landlords must justify denying tenants permission to keep pets

* No-grounds evictions banned for tenants on periodic leases

WESTERN AUSTRALIA

Under amendments expected to come into effect in late 2024:

* Rent increases to be capped at once a year (currently twice a year)

* Rental bidding to be outlawed

* Tenants will generally be allowed to keep pets and make minor home modifications

* Landlords will retain right to evict tenants without a reason after giving them notice

SOUTH AUSTRALIA

* Landlords can increase rents twice a year with notice

* Rental bidding to be banned under proposed new laws

* Owners don't need a reason to evict tenants with notice

* Tenants must secure landlord's permission to keep pets

TASMANIA

* Landlords can increase rents once a year with notice

* Rental bidding outlawed

* No-grounds evictions banned for tenants on periodic leases 

* Tenants must secure landlord's permission to keep pets

AUSTRALIAN CAPITAL TERRITORY

* Landlords can increase rents once a year with notice

* Unlike other jurisdictions, increases are capped at no more than 10 per cent above CPI

* No-grounds evictions banned for fixed-term and periodic leases

* Tenants generally allowed to keep pets

NORTHERN TERRITORY

* Landlords can increase rents twice a year with notice

* Owners don't need a reason to evict tenants, subject to providing notice

* Rental bidding not outlawed, however property agents must not mislead tenants

* Tenants generally allowed to keep pets
