Rape charges against former NFL star Ray McDonald were dismissed Monday after his accuserfailed to testify in court, the San Jose Mercury Newsreported.
According to the report,the woman also filed a civil suit against the former 49ers defensive end and received a settlement of more than $100,000 prior to the criminal trial.
Prosecutor Chris Lamiero was disappointed that he was forced to drop the charges against McDonald due to the alleged victim's failure to cooperate.
“Despite my best efforts to convince the victim to testify, she refused,” Lamiero said in a statement, noting alleged victims of sexual assault have the right to refuse to testify. “Regretfully, Ray McDonald will not face a jury for what he did thatnight. We are disappointed that he will not be held responsible.”
McDonald was indicted by a grand jury in August 2015 after being accused of raping the woman at his home on Dec. 15, 2014.
McDonald, 32, was promptly released by San Francisco and signed with Chicagoin March 2015. However, the Bears released McDonald two months later after he wasarrested on charges of domestic violence and child endangerment. The former third-round pickhasn't played since.
