TERMS AND CONDITIONS

By entering the Yahoo!7 Fanatic Promotion (the "Promotion"), you are agreeing to the following terms and conditions (the "Terms and Conditions"):

1. STANDARD TERMS

2. ENTRY
2.1 The Promotion is open to all residents of Australia holding a valid Australian passport. Directors, officers, contractors, employees and their immediate families of Yahoo!7 Pty Limited, and associated agencies and companies are not eligible to enter the Promotion.

3. TO ENTER
3.1 Entry into the Promotion commences on Thursday 25 October 2007 @ 00:01 AEST and concludes on Sunday 15 June 2008 @ 23:59 AEDT ("the Promotion Period").
3.2 Entrants are required to create a video of themselves commentating a sporting or everyday event, or impersonating a professional sports commentator ("Submission").
3.3 The judging criteria will include without limitation:
- Originality and Creativity
- Adherence to assignment and regulations
- Overall Appeal
3.4 Entrants must complete the online application form and follow the instructions for entry, available at http://www.yahoo7.com.au/fanatic/.
3.5 Entries must be received by Sunday 15 June 2008 @ 23:59 AEDT.
3.6 Entries are to be sent via email to thefanatic2008@yahoo.com.au or posted to Fanatic Promotion, Yahoo!7 Pty Limited, PO Box R1469, Royal Exchange NSW 1225, in accordance with the instructions set out at http://www.yahoo7.com.au/fanatic/.
3.7 If the Winner is under 18 years of age as at the date of judging, a parent or guardian 18 years of ago or older must accompany the Winner in the participation of the Major Prize (the "Guardian").
3.8 Entries remain the property of the Promoter and will not be returned to the entrant.
3.9 As conditions of entry into this Promotion, and by entering a Submission, you:
(a) warrant and represent that you own all right to the Submission you are entering in this Promotion;
(b) warrant and represent that you have obtained permission from each person who appears in the Submission to enter the Submission into the Promotion, and to grant the rights to the Promoter described in these Terms and Conditions, and can make written copies of such permissions available to the Promoter upon request;
(c) warrant and represent that your Submission (i) is original to you and has been legally obtained and created; (ii) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws or regulations; (iii) has not been entered in or won previous contests or awards; and
(d) irrevocably grant to the Promoter and its subsidiaries and affiliated companies, the non-excusive license to use, distribute, reproduce, modify, adapt, and publicly display the Submission in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party.

4. PRIZES
4.1 There will be 1 (one) major winner ("Winner") and 1 (one) runner up ("Runner Up").
4.2 The Winner will be the on-camera presenter for Yahoo!7 at the Beijing Olympics (the "Major Prize"). The Major Prize includes:
-An economy class airfare from any Australian capital city (Sydney, Melbourne, Brisbane, Adelaide and Perth) to Beijing for the Winner and, if the Winner is under 18 years of age, the Guardian;
- Accommodation in Beijing (four star hotel or equivalent) for the duration of the Beijing Olympics for the Winner and, if the Winner is under 18 years of age, the Guardian;
- 2000 AUD spending money;
- 1 x Panasonic Full High Definition Plasma televisions, model no. TH-50PZ700A (RRP $5,399 inc. GST); and
- entry to designated events at the Beijing Olympic Games as determined by the Promoter in its absolute discretion.
4.3 Total Major Prize value up to 20,399 AUD.
4.4 The Runner Up will receive the following Minor Prize:
- 1 x Panasonic Full High Definition Plasma televisions, model no. TH-50PZ700A (RRP $5,399 inc. GST).
4.5 Total Minor Prize value up to 5,399 AUD.
4.6 Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for any variations in the value of a prize as quoted in the Terms and Conditions.
4.7 The Winner is responsible for all other expenses in connection with the Major Prize, including but not limited to, spending money (unless specified), entry tickets to the Olympic Games (unless specified), meals, travel insurance, airport / government taxes (including departure tax), incidentals, activities (unless specified), passports, visas, travel to and from departure point (unless specified), all transfers other than those specified, insurance and all other ancillary costs. Unless expressly state all other expenses become the responsibility of the Winner.
4.8 The Winner must be available, and able, to travel to the Beijing Olympics between the period of August 1st 2008 to August 26th 2008.
4.9 By entering this Promotion, the Winner and Runner Up agree to participate and co-operate as required in all editorial activities relating to the Promotion, including but not limited to being interviewed and photographed. The Winner and Runner Up agree to granting the Promoter a perpetual, royalty-free and non-exclusive licence to use such footage and photographs.
4.10 Prizes are not transferable or redeemable for cash. The Winner and Runner Up should seek independent financial advice about any tax implications that may arise from the prize winnings.

5. TO WIN
5.1 All entries will be judged at the Promoter's offices at Level 2/Lot 2/Pier 8&9, 23 Hickson Rd, Millers Point NSW 2000 on Wednesday 18th June 2008 with 1 (one) Winner being selected.
5.2 The Winner will be the entrant that the judges select to be the most suitable to be the on-camera presenter for Yahoo!7 at the Beijing Olympics. The Runner Up will be the entrant that the judges select to be the second best entry, based on the judging criteria.
5.3 The Promotion is a game of skill and chance plays no part in determining the winners.
5.4 The judging of the Winner and Runner Up will take place on Wednesday 18th June 2008 and the Winner and Runner Up's name will be published online at http://www.yahoo7.com.au/olympics/. The Winner and Runner Up will also be notified by a phone call on the day of the judging, and a letter advising the Winner and Runner Up of their prize will also be express posted.
5.5 The judges' decision is final and the Promoter will not enter into correspondence regarding the result.
5.6 It is a condition of accepting a prize that the Winner and Prize Winner (and any Guardian) must comply with all the conditions of use of the prize and prize suppliers' requirements.
5.7 It is a condition of accepting the Major Prize and/or the Minor Prize that the Winner (and any Guardian) and Runner Up may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.8 In addition to any other rights, the Promoter reserves the right at its sole discretion to disqualify any individual who tampers with the entry process or the operation of the Promotion who is determined at the Promoter’s absolute discretion to be acting in violation of these Terms and Conditions.

6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Promotion on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions.
6.2 Yahoo!7 Pty Ltd assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.3 If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion.
6.4 Yahoo!7 Pty Ltd and its associated agencies and companies are not liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
(a) during the judging;
(b) whilst undertaking any travel won on or connected with entry into the Promotion;
(c) in the participation in any prize (including the Major Prize and Minor Prize);
(d) as a consequence of late, lost or misdirected mail; or
(e) due to the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person.

7. GENERAL CONDITIONS
7.1 This Promotion is governed by the laws of New South Wales, Australia.
7.2 By entering, you release and hold harmless, and will procure that the Guardian releases and holds harmless, Yahoo!7 Pty Limited and its parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity.
7.3 The Promoter reserves the right to alter these Terms and Conditions, withdraw any prize from the Promotion, substitute any component of the prize, or alter or cancel all or part of the Promotion in its absolute discretion without notice.
7.4 In the event of a dispute, the Promoter’s decision is final and no correspondence will be entered into.

8. PROMOTER
8.1 The Promoter is Yahoo!7 Pty Limited (ABN 60 089 187 100) Pier 8/9, 23 Hickson Rd, Millers Point NSW 2000.
8.2 By entering this Promotion you agree to Yahoo!7's use of your personal information as described on Yahoo!7's Privacy Policy http://privacy.yahoo.com/privacy/au. All entries become the property of Yahoo!7 Pty Limited and your name may be included on a database. By entering this competition you consent to Yahoo!7 including your name in future mail, email, SMS or other campaigns.
